These Terms and Conditions ("Terms") govern your access to and use of the website located at sobczakexteriors.com and our estimate and booking pages at sobczakexteriors.yourlocalestimate.com (collectively, the "Site") and any products, services, communications, or content offered by Sobczak Exteriors LLC ("Sobczak Exteriors," "Company," "we," "us," or "our"). By accessing or using the Site, requesting a quote, purchasing products or services, or opting in to receive communications from us, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Site or purchase our products and services. By using the Site, you represent and warrant that you meet these requirements.

3. Products, Services, and Quotes

All product descriptions, pricing, specifications, and availability shown on the Site are provided for informational purposes and are subject to change without notice. Quotes are valid for the period stated on the quote and are subject to final measurement, site inspection, and verification. Final pricing, scope of work, and warranty terms will be set forth in a written agreement signed by both parties before work begins.

We reserve the right to refuse service, decline orders, or cancel quotes at our discretion, including in cases of suspected fraud, pricing errors, or inability to fulfill the work as specified.

4. Payment Terms

Payment terms, deposits, and balances due will be set forth in your individual sales agreement or invoice. Late payments may be subject to interest charges and collection costs as permitted by Missouri law and your signed agreement.

5. Warranties

Any warranties applicable to the products or installation services we provide are set forth in your written sales agreement and any manufacturer warranty documents delivered with the product. EXCEPT AS EXPRESSLY STATED IN A WRITTEN AGREEMENT, SOBCZAK EXTERIORS LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SITE OR ANY INFORMATION CONTAINED ON IT.

6. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

Use the Site in any way that violates applicable law or regulation;

Attempt to gain unauthorized access to any portion of the Site, our servers, or any connected systems;

Use any automated means (bots, scrapers, etc.) to access the Site without our prior written consent;

Interfere with the proper functioning of the Site or transmit any viruses, malware, or harmful code;

8. User-Submitted Content

If you submit any content to us — including reviews, testimonials, photos, comments, or feedback — you grant Sobczak Exteriors LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content in connection with our business and marketing. You represent that you own or have the rights to submit any content you provide and that it does not infringe the rights of any third party.

9. SMS / Text Message Communications

This Section 9 is the agreement between you and Sobczak Exteriors LLC governing text (SMS/MMS) messages we send to phone numbers you provide. By providing your mobile phone number to us and opting in to receive text messages, you agree to the terms of this Section 9.

9.1 Program Description

Sobczak Exteriors LLC operates an SMS messaging program to communicate with current and prospective customers regarding our roofing, siding, gutter, and related exterior services. Through this program, we may send messages including, but not limited to:

Quote follow-ups and scheduling confirmations

Appointment reminders for in-home estimates and project work

Order and project status updates

Customer service responses to inquiries you initiate

Account, billing, and payment notifications

Occasional promotional offers, seasonal specials, and product information

9.2 Consent and Opt-In

You will only receive text messages from Sobczak Exteriors LLC if you have expressly opted in by:

(a) submitting your mobile phone number through a form on sobczakexteriors.yourlocalestimate.com and checking the SMS consent box; (b) providing your number to a Sobczak Exteriors LLC representative and agreeing verbally or in writing to receive text messages; or (c) texting a keyword to one of our published phone numbers.

Consent to receive text messages is not a condition of purchasing any product or service from Sobczak Exteriors LLC.

9.3 Message Frequency

Message frequency varies based on your interaction with us and the status of any active project, quote, or order. You may receive multiple messages per week during active projects and fewer during inactive periods.

9.4 Message and Data Rates

Message and data rates may apply. Sobczak Exteriors LLC does not charge for the messages we send, but your mobile carrier may charge you for sending and receiving text messages based on your wireless plan. Contact your carrier for details.

9.5 Opt-Out (STOP)

You may cancel SMS messages from Sobczak Exteriors LLC at any time. To opt out, reply STOP to any text message you receive from us. After you send STOP, we will send one final confirmation message acknowledging your opt-out, and you will not receive additional messages from that program unless you opt in again. 9.7 Supported Carriers and Carrier Liability

Our SMS program is available on most major U.S. wireless carriers, including AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, Boost Mobile, Cricket, and Metro by T-Mobile. Carriers are not liable for delayed or undelivered messages. Service availability is not guaranteed in all areas or on all devices.

9.8 Privacy and No Sharing of Mobile Information

Sobczak Exteriors LLC respects your privacy. No mobile information, including phone numbers and SMS consent, will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing related to our SMS program is limited to subcontracted service providers (such as messaging platform providers and carriers) that are necessary to deliver the messages you have requested, and these providers are contractually prohibited from using your information for any other purpose. This restriction applies in addition to and overrides any more general data-sharing language found in our Privacy Policy. 9.9 Changes to the SMS Program

Sobczak Exteriors LLC may modify or terminate the SMS program at any time, with or without notice. We may also modify the short codes or phone numbers from which messages are sent, the types of messages sent, or these SMS terms.

By checking this box and providing my mobile phone number, I consent to receive recurring text messages from Sobczak Exteriors LLC at the number provided regarding quotes, appointments, project updates, customer service, and promotional offers. 10. Email Communications

By providing your email address to us, you consent to receive email communications from Sobczak Exteriors LLC, including transactional emails (quotes, order confirmations, project updates) and, where you have opted in, promotional emails. You may unsubscribe from promotional emails at any time using the unsubscribe link in any such email.

11. Privacy

Your use of the Site and our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimers

THE SITE AND ALL CONTENT ON IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SOBCZAK EXTERIORS LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THE SITE, THE ACCURACY OF ANY INFORMATION ON THE SITE, OR THE AVAILABILITY OF ANY PRODUCTS OR SERVICES. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SOBCZAK EXTERIORS LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY SMS COMMUNICATIONS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00). NOTHING IN THIS SECTION LIMITS LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

This Section 13 does not limit the warranties or remedies provided in any signed sales or installation agreement between you and Sobczak Exteriors LLC.

14. Indemnification

You agree to indemnify, defend, and hold harmless Sobczak Exteriors LLC and its members, managers, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising from (a) your breach of these Terms; (b) your misuse of the Site; or (c) your violation of any applicable law or the rights of any third party.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws principles. Any legal action arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in St. Louis County, Missouri, and you consent to the personal jurisdiction of such courts.

16. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated effective date. Material changes will be communicated by posting a prominent notice on the Site or, where appropriate, by contacting you directly. Your continued use of the Site or our services after the effective date of any updated Terms constitutes your acceptance of those Terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid or unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

18. Entire Agreement

These Terms, together with our Privacy Policy and any signed sales or installation agreement between you and Sobczak Exteriors LLC, constitute the entire agreement between you and Sobczak Exteriors LLC regarding your use of the Site and our communications. In the event of a conflict between these Terms and a signed sales or installation agreement, the signed agreement controls with respect to the products and services covered by it.
